As previously discussed, in the current international law regime governing outer space development, there are five main treaties that are active.France, which has signed the 1979 Moon Agreement, but has not yet ratified it, could be at the origin of such an initiative. This framework agreement was supplemented by four specific international treaties: the Astronaut Agreement of April 22, 1968, the Convention on International Liability for Damage Caused by Space Objects of March 29, 1972, the Convention on the Registration of Objects Launched in Space of January 14, 1975, and the Agreement Governing the Activities of States on the Moon and Other Celestial Bodies of December 18, 1979.

Article VI of the OST only imposes on states parties to the treaty international responsibility for national activities in outer space, and also stipulates that states shall authorize and continuously supervise non-governmental space operations, so appropriate control regimes of private space activities have to be established at the national level.
